The World Trade Organization (WTO) Appeal Panel has maintained the core of China's preliminary ruling on restricting the export of multiple raw materials; this move may trigger similar actions by the US and Europe on China's rare earth exports. The WTO confirms that China imposes export tax and export quotas on raw materials for the steel and chemical industries, which violates the international trade rules and must be corrected. US Trade Representative Ron Kirk said the WTO decision was a huge victory for the United States. The United States filed a lawsuit in 2009, accusing China of restricting the export of various industrial raw materials such as bauxite and coke, which lowered the prices of raw materials in China and provided unfair convenience to Chinese domestic producers. The European Union and Mexico also joined the United States to file a lawsuit against China. The WTO Appeal Panel did not maintain all the preliminary rulings and overturned rulings on China's export licenses, minimum export price requirements, export quotas and fee management. However, the WTO Appeals Panel maintained the core content of the preliminary ruling that China's export taxes and quotas on various industrial materials violated WTO rules and rejected China's appeal based on environmental protection or supply shortages. The WTO Trade Dispute Resolution Body will decide whether to adopt the opinion of the expert group within 30 days, and then China will have to submit a proposal for compliance. The WTO's ruling on this lawsuit has been closely watched by all parties; the United States and other countries will decide how to exert greater pressure on China and urge China to relax restrictions on rare earth exports. US trade officials said the ruling on China's raw material export restrictions lawsuit may help to take action against China's restrictions on rare earth exports.
